Photography Contract Sample
This Agreement is executed on [Today’s date] between [Your Firm Name], (a partnership firm hereinafter referred to as "the Agency" which expression shall include its successors and assigns) and [Client Name] (hereinafter referred to as "the Client", which expression shall include its successors and assigns). The Agency and the Client are hereinafter each referred to as a ‘Party’; and together the ‘Parties’.
It is agreed by and between the Client and the Agency as follows:
Appointment
The Client hereby appoints the Agency to provide professional photography services for [event/occasion name, e.g., Wedding/Event/Photoshoot].
Objective and Scope of Services

Commencement and Duration

Agency Fees and Payment Terms

Copyright and Usage
10.1 The Client acknowledges that the Agency retains ownership of all copyrights to the photographs taken during the event. The Client will receive a license to use the photographs for personal and non-commercial purposes only.
10.2 The Agency may use the photographs for its portfolio, website, and marketing purposes, unless the Client requests otherwise in writing prior to the event.
Taxes
All statutory taxes/levies shall be borne and paid by the Client over and above the agreed amount.
Indemnity
The Agency shall indemnify and keep the Client indemnified against all losses, expenses, or damages that may be suffered by the Client due to any breach of terms by the Agency under this Agreement. Likewise, the Client shall indemnify and keep the Agency indemnified against all losses, expenses, or damages that may be suffered by the Agency due to any default or breach of terms by the Client under this Agreement.
Non-Solicitation
Both the Client and the Agency hereby covenant that during the term of this Agreement and for a period of one year following its termination or expiration, neither Party shall employ or contract the services of any person who was employed by the other Party.
Force Majeure
Neither the Client nor the Agency shall be liable for any default, delay, or lapse occurring due to events beyond their control, including but not limited to acts of God, strikes, theft, war, or riot.
Evaluation
The Client and the Agency shall evaluate the progress and deliverables under this Agreement after completion of the services and address any issues requiring corrective actions.
Modification in Terms
Any changes in the terms and conditions of this Agreement shall have effect only if recorded in writing and signed by the authorized representatives of both the Client and the Agency.
Waiver
The failure of either Party to enforce any provision of this Agreement shall not affect their right to require complete performance by the other Party. Any waiver of a breach must be documented in writing.
Termination
Either Party may terminate this Agreement by giving one month’s written notice to the other. In case of termination, the Client will pay the amount invoiced for services rendered until the termination date. The obligations of the Parties shall continue during the notice period.
